Freight Policy to Latin America Ex Works

1. Shipping Terms

• INCOTERMS: The shipping term used will be EXW Miami. This means that the seller makes the merchandise available to the buyer at its establishment in Miami, Florida, United States. The buyer is responsible for all costs and risks from that point forward, including freight, insurance, customs and final delivery.

2. Delivery location

• The place of delivery will be the seller's establishment in Miami, Florida, United States.

• The buyer is responsible for organizing the collection of the merchandise at the seller's establishment.

3. Freight costs

• The buyer is responsible for all freight costs from the seller's establishment in Miami to its final destination.

• The seller may provide the buyer with information on shipping companies and obtain freight quotes on behalf of the buyer, but the contracting and payment of freight will be the sole responsibility of the buyer.

4. Shipping methods

• The buyer is responsible for choosing the shipping method that best suits their needs.

• Seller may provide information on different shipping methods available, but assumes no responsibility for buyer's selection of shipping method.

5. Insurance

• The seller is not obliged to insure the merchandise.

• The buyer may choose to take out insurance for the merchandise at his own cost.

6. Customs

• The buyer is responsible for all customs procedures and duties in the destination country.

7. Shipping damage

• The buyer assumes all risks of loss or damage to the merchandise once it has been delivered to the seller's establishment.

• The seller is not responsible for damage to the merchandise that occurs after delivery to its establishment.

8. Returns

• Returns of merchandise are not accepted unless the merchandise is damaged or defective at the time of delivery to the seller's establishment.

• In case the merchandise is damaged or defective at the time of delivery, the buyer must submit a claim to the seller within 7 days of delivery.
